Study the following case study of misconduct by a translator and answer the questions
that follow.
Case Study 1
Mr Jogoo, a freelance translator with a reputable track record in legal document
translation, was hired by a law firm to translate a series of confidential legal contracts
from English into Kiswahili. Mr Jogoo appeared well-equipped for the task, possessing
both linguistic proficiency and legal expertise.
During translation, Mr Jogoo encountered a clause in one of the contracts that posed
a challenge due to its complexity and ambiguity. Instead of seeking clarification
from the client or conducting further research to ensure accurate interpretation, Mr
Jogoo paraphrased the clause, altering its meaning significantly. The mistranslation
went unnoticed during the initial review process, and the translated documents were
submitted to the client.
