             The summary

            The  South African  special  tribunal  has  ordered  SAP  to  repay
         FOR ONLINE READING ONLY
            $26 million earned through corrupt contracts with Eskom, citing
            violations of public finance laws between 2013 and 2016. The
            payment order stems from a settlement with the anti-corruption
            agency SIU,  upheld by the Special  Tribunal, which found the
            contracts to be constitutionally invalid. SIU  seeks to recover
            losses from negligence or corruption suffered by state institutions
            and clarifies that the settlement does not shield SAP from potential
            prosecution. SAP must remit the payment to SIU within seven
            days. In January, the company agreed to settle a $220 bribery
            charge  involving  government  officials  in  various  countries
            including South Africa. The company allegedly paid consultation
            fees for undelivered services and funding trips to New York and
            golf outings for government officials in South Africa.
